Chapter 2 of the Handbook illustrates how policy is established and translated into regulations, rules and guidelines. It cites Alaska’s Procurement Code for having embodied several noteworthy best practices. These features strike a balance between fair and open competition and economy.

 

This 46-page law has some interesting features. First, it is a law providing more than twenty pages of instructions and direction dealing with the details of the procurement process.  It is also representative of many of the jurisdictions that have based their procurement code on the Model Procurement Code.

 

Some of the noteworthy features detailed in this law are:

 

·          The Chief Procurement Officer must have procurement experience (this is not a political appointment).

·          Specifications cannot be unduly restrictive.

·          RFPs must provide 21 days to develop a proposal.

·          Proposals are public documents.

·          'Best and final' offers are permitted.

·          Single source procurements must be justified in writing.

·          There is a formal protest procedure.
