Secret #52 – Now (six months before the crisis) is the time to confirm that your RFP process and the related documents are ‘legal’.

Hear what the President of NASPO says about this book . . .

“Michael Asner's book removes a lot of the RFP process mystery.  It is one of very few RFP books that address the negotiation process.  I refer to Mr. Asner's book often and it is recommended reading for public procurement officers.”

Chapter 2 of The Request For Proposal Handbook (Third Edition) deals with how to implement an effective RFP policy.

Secret #52 – Now (six months before the crisis) is the time to confirm that your RFP process and the related documents are ‘legal’.

Chapter 2 of the Handbook deals briefly with this issue.

Is it legal? Few organizations perform an audit of their procurement policies, procedures, documents and forms to ensure that they are still legal. The courts in many jurisdictions have influenced RFP practices. They have condoned some practices, prohibited others, and prescribed specific rules of conduct. An organization's ability to change the content of the RFP, and to deal with suppliers is constrained by laws, and court rulings. Laws change and courts constantly issue rulings which influence procurement. If your organization has not reviewed its documents and practices in the last few years, there is a good possibility that some of your terms and conditions, or practices are no longer proper.

Many jurisdictions now have access to information laws governing the release of information by public bodies. Using these laws, much information previously kept secret is now routinely released, released as part of the debriefing process, or released upon formal application by a vendor. So ensuring that your policies, documents and practices comply with the governing laws is more critical than ever.

Learn how you can reduce the risks by developing a more effective RFP and a better process. Learn about the best practices from more than sixty jurisdictions based on Michael Asner’s 20-years of experience.
